This Privacy Policy for Freeze Defense LLC ("Freeze Defense", "Company" , "we," "us," or "our"), describes how and why we might collect, store, use, and/or share ("process") your information when you use our services ("Services"), such as when you visit our website at www.freezedefense.net (the "Website"), and when you make a purchase at our Website. This Policy only applies to information that is collected via the Website. It does not apply to information collected offline, or otherwise outside of the Website.

    Functionality cookies: These cookies are used to allow the Website to remember choices you make, such as the language or region you are located in, and provide enhanced and more personal features. 6. How and When Do We Disclose Information to Third Parties?

General. We may share Personal & Usage Information with third parties. We may share data related to you and your activities on our Website by using your Device Identifiers. We do not share Personal Information that we have collected directly from you on the Website with third parties for those third parties' marketing purposes unless you consent to the sharing at the time of personal information collection. In additional, we may share information we have collected about you, including Personal Information, as disclosed at the time you provide your information, and as described below, or otherwise in this Policy.

We are not responsible for the Privacy Policies and practices of Advertisers, or any other third parties, and therefore, you should review third party privacy policies and practices of such third parties prior to requesting information, or interacting with them.

We will not share Personal Information with any Advertisers.

Third Parties Providing Services on Our Behalf: Third party vendors may be used by us to perform certain services on behalf of us or our Website. This including web hosting, operating and designing features of the Website, tracking Website activity and analytics, and other administrative services. We may provide vendors with access to user information, including Device Identifiers and Personal Information in order to carry out the services they are providing for you, or for us. Third party analytic services may set and access their own Tracking Technologies on your device, and may otherwise collect or have information about you, including potential Personal Information. We are not responsible for those third party technologies, or activities that may arise out of them. We are not responsible for the effectiveness, or compliance, with any third party opt-out options.

Administrative & Legal Reasons: We may access, use, preserve, transfer, and disclose your information, which includes Personal and Device Information, to satisfy applicable laws, regulations, subpoenas, governmental requests, or legal processes, if in our good faith opinion such information is required or permitted by law. We may use Personal and Device Information to protect and/or defend this Website, or other policies applicable to the website. We may use such information to protect the safety, rights, property, or security of the Website or any third party. Or, we may use such information to detect, prevent, and address fraud, security, or technical issues. Further, we may use Device Identifiers, or IP addresses, to identify users. We may so do in cooperation with third parties such as copyright holders, internet service providers, wireless service providers, and/or law enforcement agencies, including disclosing such information to third parties, all in our discretion subject to applicable law. Such disclosures may be carried out with no notice to you.

Business Transfer: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

7. Other Privacy Rights

In some regions (like the EEA, UK, and Canada), you have certain rights under applicable data protection laws. However, please note that this will not affect the lawfulness of the processing before its withdrawal, nor when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us using the details provided at the end of this document. You will then be removed from the marketing lists. Account Information: If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. Further note that it is not always possible to completely remove or delete all of your information from our databases and that residual data may remain on backup media or for other reasons.

Do Not Track Signals: Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

8. Do We Collect Information From Minors?

We do not knowingly solicit data from or market to children under 18 years of age. By using the Website, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us by referring to the contact information at the end of this document.

9. How Do We Keep Your Information Safe?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Website is at your own risk. 10. How Long Do We Keep Your Information?

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

11. Is Your Information Transferred Internationally?

Our servers are located in the United States. If you are accessing our Website from outside the United States, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information, in the United States, and other countries.

If you are a resident in the European Economic Area (EEA) or United Kingdom (UK), then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this privacy notice and applicable law.

European Commission's Standard Contractual Clauses:

We have implemented measures to protect your personal information, including by using the European Commission's Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers. These clauses require all recipients to protect all personal information that they process originating from the EEA or UK in accordance with European data protection laws and regulations. Our Standard Contractual Clauses can be provided upon request. We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can be provided upon request.

12. What Legal Bases Do We Rely On To Process Your Information?
If you are located in the EU or UK, this section applies to you.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

  • Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time.
  • Performance of a Contract. We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.

13. Do California Residents Have Specific Privacy Rights?

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided at the end of this document.

If you are under 18 years of age, reside in California, and have a registered account with Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).

CCPA Privacy Notice

The California Code of Regulations defines a "resident" as:

Contact details, such as real name, alias, postal address, telephone or mobile contact number, unique personal identifier, online identifier, Internet Protocol address, email address, and account name.
